One year ago my wife was taking our daughter to pre-school turning left out the end of our road in to traffic, this road has a speed limit of 35 mph. Traffic had to stop to let her cross the first lane since it was solid cars, vans and small trucks. As she approached half-way, before getting a good view of oncoming traffic, another car took off the front bumper. Note that the center line is interuppted at the cross-junction. The bumper was torn from the front of the car with damage more evident on the non-impact side of the car than where initially hit, hence my wife had not initiated a turn, just edging forward to see. The radiator was in-tact, but damaged, still mounted to the front of the car. I walked to the site with our other child and took my daughter home; she is fine and I took her to school but still talks of the incident today. My wife stayed at the incident, and was fine (no later issues) keeping real calm and cooperating with police. It took about 2 hrs with police debating which town the incident took place (middle of the road is the divide) and the other driver was concerned about getting home to take a pot off the stove, but seemed medically fine. The driver asked me and the police to drive them home to get the pot off the stove and used my wifes cell phone more than once. They also wanted to drive their car home and leave the scene with a flat tire at one point I presume to attend to the pot. No tickets were issued, no air bags deployed. The other car had a flat front left tire and side damage so the drivers door was stuck shut. Both cars were old, so written off. Over a year later we received a court summons from their attorney and we are being sued for $750,000. Our limit is $100,000 on insurance. The plaintiff is claiming herniated discs and loss of bowel control. We have a 2006 no money down mortgage, so total equity is very much in the red since our home value plummeted. I have no umbrella policy. I am sole income, but was owner of the car my wife was driving. My wife is stay-at-home mom. The remaining $650,000 would be a big problem. Interestingly, we heard that the other driver called our insurance and asked for a >100-fold lower amount of money to just go away! Our insurer recalls this very clearly and did not pay. Questions: Should I invest in an attorney to work with our insurers attorney to cover the $650K over our limit? Do we have any case given the car the other driver may have been in a rush (as all were aware of the pot on the stove), would have settled for far less, and in reported safety tests should avoid an obstacle at 55mph let alone at the speed limit of 35 mph? Their case, as I understand, is to actually prove my wife was negligent, she was just trying to see. Reality and the law are complicated I understand. Our insurer is looking in to the validity of their medical claims. I believe for spinal and neck injuries plaintiffs have to follow careful insurance approved treatment plans in NJ. I know that such a condition may not be permanent with curative surgery possible to release the nerves that may be causing the bowel issue. The plaintiff has claimed the injury as permanent, do they need to prove this? Should we ask experts? The plaintiff lives in our town and their house is on my running route every other day. I have not noted anything at all and plan to stay away from all other parties. Should I change my running route? Thanks for any advice. Our 30 day clock is ticking.

I have a 2001 porsche and this lady just tboned me going through a red light. Now My insurance company wants to offer me about 5000 dollars less then what I can replace it for. I sent them 10 ads in the area close to my car to show them, and they in turn had me appraised by an independent agency. This agency, BIG BLOCK, came back with a dozen examples that all had more miles then mine, and adjusted me .16 cents a mile. After doing depreciation calculations on their examples, the average dep per mile was .60 cents per mile!!!! This changes their evaluation by about 7-8000 dollars overall. Its been two weeks since they totaled my car. What should I do if they keep trying to low ball me?

I just had an accident today. Me and someone else were backing up at the same time in the parking lot, and we backed into each other. I drive an Explorer, so there was only paint damage. The other car was much smaller so they have a large dent on their rear bumper. We both have Allstate for our insurance. We exchanged info, so what now? Will i have to pay for the other cars damage or will AllState do that? and how much will my insurance increase? this is my second accident. My first was 5 years ago.

I am going on vacation, and I need to rent a car to drive. I have insurance through state farm, but dont have full coverage. If I am renting, I would like to have full coverage on the rental car, BUT the insurance from enterprise is WAY TOO expensive. I will end up doubling the price for the week. Does anyone know of any other ways to get insurance for a rental car without going through the rental car agency? I keep hearing about something called Unlimited Non-Owned Car Coverage, but I dont think state farm has that because I dont see it on their website. Any suggestions would be a great help.

Okay there was a massive understanding. My mum and dad were getting my quotes for cars and they got me a quote for a Mitsubishi Colt 1.1 Black Hawk. Nice little car. The quote they got was 750 for my own insurance PROVISIONALLY. I tried telling that them reason it was that much was because it was provisional insurance. Not till they gave me the money for the car and told me to buy, did they realise that insurance is different now and you have to re-new it to full UK manual as soon as you pass your test. I've been looking at quotes and they're looking well to expensive for my own insurance. Is there a cheaper way? Like going on my mum and dads insurance? Why won't my insurance company let me transfer our No Claims Discount to a different car/policy?

We have been insuring our Audi with the Co-op, who I've generally found to be reasonable. However, now we have a problem. A couple of months ago we bought a van with the intention of replacing the Audi with the van. But the van needed some work doing on it, so we took out a second insurance on the van with the Co-op, so we could still drive the Audi. At the time, I was disappointed to be told that we could not have a No Claims Bonus on the van, as they said it could only be applied to one policy at a time. But they gave the clear impression that when we cancel the Audi insurance, we could then transfer the NCB to the van. The Audi has now broken down, so we want to cancel its insurance. However, yesterday when I called them, they now said they cannot transfer the NCB to the van as it would be being transferred 'mid-season' to a different car policy. They said they could only have applied it to the van if we had changed the original Audi's policy to cover the van, instead of taking out a different insurance policy for the van. This seems ridiculous. Surely, we are entitled to our NCB?! Why should it matter that it is mid-season or not? I explained that if I cancelled our insurances with them and went to another company, I would be given a NCB on the van so why won't they give it to me. They agreed! I really don't want to change, as I don't trust other companies and the Co-op seem more ethical than others. But this seems so stupid. To get round this silly rule without changing company, I'm thinking of cancelling the van insurance and changing the Audi insurance to the van, ie. do what they said I should have done in the beginning. What do you think?! (Also, is it ok to keep the Audi uninsured, given that it cannot be driven, but is parked on a public road?)

How exactly will the small business I work for be affected at all by the health care bill?

I work for a small business that employs around 15 people. The owner purchases insurance for all the employees. I keep hearing opponents say that this bill is going to hurt small businesses, but I don't see how it would hurt the one I am employed by. My company already purchases insurance, and even if it didn't, we don't have the 50 or more employees required for the government mandate to purchase insurance to apply to us. Therefore, it seems like everything will remain the same for us. If someone out there can offer me any insight as to how my company will be negatively affected by this bill, please come forward.
